Terms of Service

These Terms of Service ("Terms") govern your access to and use of GameMinder, including our web app, Discord bot, and any mobile applications that link to these Terms (collectively, the "Services"), operated by MythicByte ("we," "us," or "our").

By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this requirement.

The Services are intended for users located in the United States. Access from outside the United States may be restricted.

2. Your Account

You are responsible for maintaining the security of your account credentials. Do not share your password with anyone. You are responsible for all activity that occurs under your account.

If you believe your account has been compromised, contact us immediately at support@gameminder.io.

We reserve the right to disable accounts that violate these Terms or that we reasonably believe have been compromised.

3. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Harass, threaten, or harm other users
  • Upload or transmit malicious code or interfere with the Services
  • Attempt to gain unauthorized access to any part of the Services or another user's account
  • Scrape, crawl, or systematically extract data from the Services without our written permission
  • Use the Services for any commercial purpose not expressly permitted by us
  • Impersonate another person or misrepresent your affiliation with any person or organization

We reserve the right to suspend or terminate access for any violation of these rules.

4. User Content

The Services allow you to create and share content, including campaign descriptions, session notes, survey responses, and member goals ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive license to store, display, and process it solely to operate and provide the Services.

You are responsible for ensuring your User Content does not violate any third-party rights or applicable law. We do not review User Content before it is posted and are not responsible for it.

5. Discord Integration

The Services integrate with Discord. Your use of Discord is governed by Discord's Terms of Service and Privacy Policy. We are not responsible for Discord's services or any issues arising from your use of Discord.

6. Intellectual Property

The Services and all content we provide — including the GameMinder name, logo, design, and software — are owned by MythicByte and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Services without our written permission.

7. Third-Party Services

The Services may integrate with or link to third-party services (such as Discord and Firebase). We are not responsible for the content, availability, or practices of any third-party services. Your use of third-party services is governed by their respective terms.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, MythicByte and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Services will not exceed $100.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion.

You may delete your account at any time through your account settings. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising from these Terms or the Services will be resolved in the courts of Florida.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify you by email or by a prominent notice within the Services. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
